This tip sheet explains leave and pay rights for parents and other close family members who need extended time off work to care for children with serious health conditions, including preterm infants in the neonatal intensive care unit (NICU). These rights are available regardless of immigration status. It includes information on qualifications, ways to obtain legal advice, FAQs, and sample timelines to help providers guide parents and families.

Legal Aid at Work originally developed this tip sheet in partnership with CPQCC in March 2022.  It was updated in January 2023 to reflect changes to California law.
